I participated in a hearing today (8/14/23) that I thought would be an easy win...
So how did I lose?
The answer is I did not have an ESQ at the end of my name... i.e. I am not attorney so of course I cannot be taken seriously.
Let me set the scene:
I was sued. Not once, not twice but THREE times by a man named Stephan D. Vanyo. I was sued by a slumlord that has sued almost every tenant for the exact same issues! He even told the Court I was a drug trafficker... HA - back in 2012-2014 these three hearings went as follows:
First one the slumlord withdrew his case after wasting everyone's time and appearing for the hearing he was suing for eviction despite the fact we were already packed and moving...
Second suit he decided to sue for over $7,000 and guess what ? He lost.
Third suit - this is the fun one - he claimed I tried to pay him rent in marijuana when I noticed he was "lethargic" and that I am a drug trafficker..... this one he lost AND I won a judgment against him as he had no proof because ya know... I was not and am not and never will be a drug trafficker. I won.
Sadly, he did not pay and over the course of the years due to medical issues I did not have the filing fee to enforce the judgment... i.e. make the lying bastard pay.... well it just so happens that I am working full time, bought a house and had some savings so I file the Motion and guess what? the SOB apparently filed for bankruptcy!!!! Never notified the Court... or the people he owed (well, at least me) so I never went to the hearing... yet... his attorney said I knew... said my ONE motion to enforce was me abusing the Court system and that I was harassing him... meanwhile I thought I had it in the bag because
1. I never did receive a notice.
2. I wouldn't have paid $135 to file the darn motion - hey it's a lot of money....
3. they never advised the Court (I had the Judgment in) of his bankruptcy... and most importantly
4. According to Bankruptcy Code: 11 U.S.C. Section 523 (a)(6) . "Your cross claim against him which you won was for willful and malicious conduct only. You didn’t plead anything else so 100% of that judgment should have been non-dischargeable." - this bit is from a person with ESQ at the end of her name ... yet... I was given less than 20 seconds in front of a bully Judge who refused to hear me.
I am quite angry but sadly, not surprised.
